We are able to prepare wills and advise on succession and inheritance tax planning.

 

We have many years’ experience in providing comprehensive will and succession planning advice for high net worth families, farmers, landowners and business owners and advising in relation to agricultural and business property reliefs.

We are able to advise in relation to and deal with the registration of Enduring Powers of Attorney made prior to the change in legislation in October 2007.


We are able to advise in relation to and prepare Lasting Powers of Attorney for both Property and Financial Affairs and Health and Welfare and to attend to the registration of these at the Office of the Public Guardian.


We are also able to advise attorneys in relation to their management of property and financial affairs under Enduring or Lasting Powers of Attorney.


We can advise in relation to and prepare Ordinary Powers of Attorney.

We can advise in relation to deceased’s wills and the administration of estates whether you are the executor or a beneficiary of an estate.


We are also able to provide advice and guidance if you are acting as an executor and wish to obtain the grant of probate and deal with the administration of an estate yourself. Our advice will help protect you from incurring personal liability as an executor.


We are also able to make the application for a grant of probate (or letters of administration if there is no will) and complete inheritance tax account should you wish to deal with the rest of the administration of the estate yourself.


We are also able to deal with the full administration of an estate including obtaining a grant  of probate (or letters of administration where there is no will). The administration of an estate will include the completion of the inheritance tax account, collecting assets, paying legacies, vesting the property in beneficiaries, inheritance tax planning both for the estate and future generations, the preparation of estate accounts and the distribution of funds.

 

We have many years’ experience and particular expertise in dealing with the administration of estates for wealthy individuals, business owners, landowners and farmers. In addition to the matters referred to above, our advice will cover the important issues of agricultural and business property reliefs and the transfer of the farm and business assets to the beneficiaries or trustees.

We are able to advise in relation to and prepare lifetime discretionary or life interest trusts which are likely to form part of your inheritance tax planning and will normally involve the use of the inheritance tax nil rate bands, the normal expenditure out of income exemption or business or agricultural assets.


We are also able to advise in relation to existing trusts whether you are a trustee or a beneficiary.


We are also able to advise in relation to and deal with the management and administration of trusts and the preparation of trust accounts.

At The Garfitt Law Partnership LLP we have experience in dealing with all manner of property transactions, both commercial and residential, with particular expertise in relation to agricultural land, including sales and purchases of farms and other rural properties.


We are able to deal with transfers of equity, deeds of gift, assents and sales as part of the administration of estates.

Taxation advice is best provided by your Accountants who have an all-round knowledge of your taxation affairs in relation to inheritance tax, capital gains tax, income and stamp duty land tax. Although we may comment on taxation and will work with your accountants, our advice does not include taxation advice unless agreed in writing with you.
